By issuing a written or verbal order, the buyer is deemed to have accepted the following conditions unless varied and agreed in writing by James Nilsson Ltd.

All goods are to be paid for in full prior to dispatch. Bank to bank payments are to be credited to 03 0285 0305704 000 at Westpac Bank, Wairau Road, Auckland 0627 New Zealand and will incur a NZ$25.00 bank fee imposed by the banks. Visa and Mastercard are accepted. Partial deliveries may be made and invoiced. No goods will be dispatched until paid for in full. There is no surcharge on credit card transactions.
Must be paid on all transactions except where James Nilsson Ltd is the exporter or where the buyer supplies a copy of customs exemption.
Where a deposit is called for, no work shall commence until full deposit is received in cleared funds at our bank. Where an order is cancelled, the deposit is refundable less any costs of labour, materials, subcontractors services, freights, design, development and proposal work incurred prior to the cancellation.
Where progress payments are called for, they are due immediately and will be remitted by the buyer without undue delay. Progress payments are non refundable.
Price lists may change without notice. In the event of a price change, James Nilsson will notify the buyer and agreement shall be reached before despatch.
All prices are quoted in NZ$ ex store, Auckland. Goods may be delivered freight forward or freight paid by negotiation. The buyer will be notified when there goods are ready for dispatch. Depending on the delivery service chosen by the buyer, a tracking number may be issued by James Nilsson Ltd. Export deliveries can take up to 25 days depending on the service chosen by the buyer.
Risk in all goods becomes the responsibility of the buyer from the time of despatch unless specifically arranged in writing otherwise.
Ownership of all goods and materials is expressly retained by James Nilsson Ltd. Until all outstanding debts owed by the buyer to James Nilsson Ltd. have been paid in full.
James Nilsson Ltd. will not be responsible for any consequential loss, damage or cost incurred by the buyer or end user, as related to fitness for purpose, design, quality of materials or workmanship, failure to deliver by specified date or for any other reason.
Goods may only be returned for credit with prior agreement of James Nilsson Ltd. A re-stocking fee may be charged. In any circumstances, goods will only be accepted for credit if returned in perfect "as new" condition including accessories, literature and unmarked packaging. In all cases the original invoice number and date and date of purchase must be made known to James Nilsson Ltd. Customised products can not be returned.
Cancellation of your order is at the discretion of James Nilsson Ltd. Customised products can not be cancelled or returned.
If a fault is suspected during the warranty period, the Buyer will not remove any parts from a product or attempt any repair unless so authorised in writing by James Nilsson Ltd. The product may be required to be returned to James Nilsson Ltd, freight paid, with a detailed description of the problem experienced, details of installation, serial number and evidence of purchase.
These terms and any dispute arising from the supply of goods by James Nilsson Ltd shall be governed and construed in accordance with the law of New Zealand and the parties to this contract will submit to the exclusive jurisdiction of the High Court in Auckland,New Zealand.
